Does the Right to Elective Abortion Include the Right to Ensure the Death of the Fetus? - Stephen G. Gilles Quinnipiac University School of Law January 2, 2015

Abstract:

Is the right to an elective abortion limited to terminating the woman’s pregnancy, or does it also include the right to ensure the death of the fetus? Important as this question is in principle, in today’s world the conduct that would squarely raise it cannot occur in practice. The right to elective abortion applies only to fetuses that are not viable, which by definition means that they have been determined to have no realistic chance of surviving outside the uterus. Even if abortion providers used fetus-sparing methods rather than the fetus-killing methods they currently prefer, pre-viable fetuses would die within minutes. In the not-so-distant future, however, new artificial-womb technologies may make this question an urgent one by enabling pre-viable aborted fetuses to survive to full term if a fetus-sparing abortion method is used. Moreover, whether a woman has the right to ensure the death of her fetus may already have important implications for state laws that regulate the destruction or indefinite non-gestation of cryopreserved embryos.

The subject, therefore, is well worth exploring, both as a matter of constitutional principle and for its present and possible future legal ramifications. To do so, this Article analyzes hypothetical state legislation enacted in the wake of two technological breakthroughs that may occur in the coming decades: (1) improved surgical techniques that enable fetuses to be removed alive from their mothers’ wombs at any stage of gestation; and (2) artificial wombs in which these fetuses can be gestated to term. The Article assumes that these dual technologies (which I refer to as “AW”) will be safe for women, not prohibitively expensive, and reasonably effective: many pre-viable fetuses would survive fetus-sparing abortions and successfully be gestated to full term in an artificial womb. The Article then supposes that a state enacts legislation prohibiting fetus-killing abortion methods and providing AW at state expense to any woman who chooses to terminate her pregnancy. 

We do not know how gestation of a fetus outside a human being's body will effect the mental health and emotions of said fetus. The effects could be profound on both Woman and Fetus/Child. Only a psychopath thinks human emotion is a thing to be ignored.

All of this 'prolife' theory is designed to take women's power and potency from them and to put women back into the box we were in before suffrage in 1920. Women have had human rights in the US for 100 years - the lifetime of one woman.

If nothing changes, on September 1st all but six abortion clinics in Texas will be closed (there were 46 in 2011).

Women will begin dying from dangerous illegal abortions. Others will be imprisoned for self-inducing abortions. Thousands more will have their lives foreclosed by being forced to bear children they do not want – shattering their dreams, trapping them in abusive relationships, and/or driving them into humiliating and dangerous poverty. Worse, this emergency in Texas is not an isolated problem.

I was pulling weeds and muttering "I do not know what to do." And then the light dawned. The Democratic Party 170th district candidate for PA State Senator is a "staunchly pro life" forced birth cultist. I am going to do a Mississippi-McDaniel on Brendan Boyle.

Our State of PA, which cannot find money for schools to educate children, has found more tax money to fund "crisis pregnancy centers" like Real Alternatives in order to manage PA women's reproductive decisions. I think PA women can manage their own sexual and family lives and should be left alone to do so.

It is state politics that we must concentrate on now, Folks. Bigtime.

Suspect In Montana Clinic Vandalism May Be Linked To Controversial ‘Crisis Pregnancy’ Center

The clinic, All Families Healthcare, was vandalized overnight Monday when one or more perpetrators broke glass and equipment throughout the office. Zachary Klundt, a 24-year-old Kalispell resident, was arrested while breaking into another building early Tuesday morning, and was promptly linked to the clinic burglary because of evidence he was carrying.

Ensuring safe access to health-care facilities: 
State Sen. Larry Farnese (D-Philadelphia) served as a volunteer clinic escort before joining the senate, so he has particular insight into the harassment that occurs outside clinics. He’s preparing to introduce SB 1208, a bill that would “enact a statewide buffer zone outside health-care facilities located in the Commonwealth of Pennsylvania.” The intention is to create a 15-foot buffer zone around driveways and entrances to health-care facilities.

State Rep. Matt Bradford (D-Montgomery), sponsor of the house companion bill, HB 1891, emphasized that the bill was “content neutral,” meaning that it would apply to all health-care facilities, not just those offering abortion services. “While everybody is entitled to their personal beliefs, people should not be allowed to interfere with the rights of others by blocking [them],” he said."  - from RHRealityCheck.org. .

A Michigan mother-of-two has claimed a Catholic hospital could have killed her after it forced her to suffer through a painful miscarriage at 18 weeks because it doesn't believe in abortion. Tamesha Means, 30, of Muskegon, with the help of the American Civil Liberties Union filed a lawsuit Friday against the United States Conference of Catholic Bishops regarding treatment she allegedly received at Mercy Health Partners hospital in December 2010. Then 27, the suit claims Means visited the hospital - the only one in her county - three times after her water broke some five months early. Mercy Health Partners is part of Trinity Health, a Catholic-run medical group that prohibits abortion in its hospitals. - By HELEN POW

Update: A Catholic hospital has argued in a wrongful death lawsuit that a fetus is not a person. Just let that sink in for a moment.

A beautiful woman has died in agony in the service of a Catholic dogma. A dogma that the Roman Catholic Church itself was willing to repudiate . . . for money. She was not a Catholic. She miscarried and made the mistake of going to a Catholic hospital.

My indignation response has been triggered so often of late that I cannot feel indignation anymore. This scares me. I am beyond wanting to hurt Forced Birthers. I am likely to stomp somebody. The State of Ohio is working on passing an abortion law just like the Irish law that killed this beautiful woman.

I need to go and find a nice safe place to decompress. Someplace where I will not be hurt for being a female. I just do not know where that place might be.

It’s time to abort the Catholic Church

The latest victim in over a millennium of Catholic abuse is Savita Halappanavar, a young woman who was 17 weeks pregnant when her condition began to deteriorate. She went to a Catholic hospital, a fatal mistake.

Rest in Peace, Ms. Savita. I pray that you are the last woman who dies because of the depraved indifference of a nation (Ireland), the Roman Catholic Church and the Morals Police simply because you are a woman.

Women Legislators walked out of a debate on a new anti abortion bill in Florida.

"A debate in Florida's House of Representatives over a Republican-sponsored ban on race- and sex-selective abortions became extremely heated Thursday, causing several black women lawmakers to walk out in protest. 

House Bill 845, sponsored by Rep. Charles Van Zant (R-Keystone Heights), would make it a third-degree felony in Florida to perform an abortion based on the race or gender of the fetus. Van Zant accused Planned Parenthood and other abortion providers of intentionally targeting black people. "The fact is, 80 percent of abortion clinics nationwide are located in minority neighborhoods where 43 percent of all black babies are aborted," Van Zant said, according to the Tampa Bay Times." - Laura Bassett, Huffpo

I gave Van Zant the AssHat Award for this sentence alone. Van Zant stated "In America alone, without the Naxi holocaust, without the Ku Klux Klan, Planned Parenthood and other abortionists have reduced our black population by more than 25 percent since 1973. The premises Van Zant is arguing here are:

Evil women have abortions for evil reasons at the request of evil organizations. Everybody knows that. A black woman is a potential Shoah just standing there in her shoes and must be specially provided for by House Bill 845.

Black women Legislators walked out and chimed in "How is it racism if they don't want black babies to be singled out for abortions?"

Is all this sheet* going to come down on black women who abort black babies only? What if a black woman is having a white baby? Does she get to have her abortion then? And what if a white woman is having a black baby? Or a red or yellow baby? Womb as Color TV. You got special probes for that? 

How will this law be enforced? What are you willing to do to women, Van Zant, to enforce this law? I sent this to Van Zant. Think I will get an answer? AssHat.

The National Republican Senatorial Committee plans to expand its press operation to train campaigns earlier in the cycle on how to better handle the kind of candidate missteps that have plagued its party’s nominees. The goal? To avoid what’s become known in GOP circles as “Todd Akin moments.”

“The campaigns that jumped off message not only infected themselves, they infected all the rest of the campaigns,” said Rob Collins, the new NRSC executive director, in his first extensive interview on the job. “So in this age of fractured but continuous, three-dimensional communication, we have to constantly plan for that and train for that and build for that.”

UPDATE:   The Growth and Opportunity Project  Report has been released. The Report evaluates what the GOP must do if they want to win elections. The report suggests that Republicans communicate their values to minorities more effectively. I excerpt part of the Report's recommendations for Women. 

5. Republicans should develop a more aggressive response to Democrat rhetoric regarding a so-called “war on women.” In 2012, the Republican response to this attack was muddled, and too often the attack went undefended altogether. We need to actively combat this, better prepare our surrogates, and not stand idly by while the Democrats pigeonhole us using false attacks. There are plenty of liberal policies that negatively impact women, and it is incumbent upon the party to expose those and relentlessly attack Democrats using that framework. 

There is not one mention of "legitimate rape" bills. No mention of attempts to relegislate Roe v. Wade and defund Planned Parenthood. We all saw that with our own eyes. They plan to language it all away. I find Republicans "scary" too:
